TERMS OF REFERENCE FOR UNDERTAKING A GENDER REVIEW OF ECOWAS EXTRACTIVE INDUSTRIES LEGAL FRAMEWORK AND POLICY

 

Context

These Terms of Reference are part of OXFAM America's HEWLET project activities and serve the purpose of carrying out a gender review of the ECOWAS extractive industries legal framework and policy.

 

In order to regulate the West African mining sector, ECOWAS has established a policy and regulatory framework for the governance of the geo-extractive sector. The idea of providing the West African region with a binding text to regulate activities in the mining sector has come from OXFAM America and West African civil society. An engagement with ECOWAS reached agreement on the instruments to be put in place with wide consultations to gather the most diverse opinions on the mining issue. Consultations have led to the idea that a regional mining code must be the outcome of the whole process. Decision was made to first draft a directive on mining before moving to the code. Thus, the ECOWAS Mining Directive was adopted in 2009 and includes, in particular, the guiding principles aiming to harmonize practices and policies with regard to the disparities noted in the mining legal documents of the Member States....
